On this page you will ONLY find trading conditions for trading with Nemdele ApS. You cannot find the individual company's trading conditions here.
When you buy in the web shop, you are not dealing with the individual car recyclers, but through a joint company Nemdele ApS.
It’s the trading conditions here, which apply to all goods purchased online through Nemdele.dk's web shop.

TRADE TERMS WITH PRIVATE

1. Payment and Delivery

  •          All prices listed are in Danish kroner incl. 25% VAT and ex stock. Shipping costs are added to the item price depending on how big the item is - see order confirmation and subsequent invoice.
  •          The amount is only deducted from the customer’s account when the item has been dispatched from us.
  •          Shipping costs:

The car recyclers/dismantlers send packages with Post Nord or carrier.
The price is variable as it depends on the package size, see order confirmation and subsequent invoice, or contact us by email to inquire about the shipping price.
The shipping costs shown apply only to bridge-fixed islands in DK. Extra delivery costs must be calculated for non-bridge-fixed islands in DK as well as goods that must be sent abroad. Contact us by email with questions about the shipping price.
When you order an item on weekdays before 1 p.m., you will usually receive the package the next working day in DK. We disassemble and ship the item on the same day, as far as possible. When ordering on weekends and public holidays, the order is processed the next working day.

  •          When ordering, you specify the address at which you wish to receive the goods.

2. Transport damage

Note: It is always the recipient who must make a complaint in the event of transport damage! 

  •          Immediately upon receipt of your goods, check whether the packaging has been slightly damaged and whether the contents are intact.
  •          In the event of damage, you must immediately contact the transport company that was responsible for the transport. Hidden damage must be reported no later than the day after receiving the goods
  •          NOTE: You must NOT acknowledge receipt if the goods appear to have been damaged during transport.
  •          The auto recyclers do not have the option of claiming compensation for transport damage if you simply return the goods to us. We therefore do NOT replace such goods.
  •          For night delivery with TNT, the Transport damage must be reported before 12 the same day
  •          It’s the customer's own responsibility to get overnight delivery. Nemdele is not liable for theft of the delivered goods.

 

3. Shipping errors and receipt control

If the delivered goods do not correspond to the order confirmation, we must be notified within 8 days of receiving the goods, as this otherwise complicates the investigation. If we are not contacted within 8 days, the order is considered to have been correctly delivered.
It is the customer's responsibility to check that the delivered goods are in accordance with the ordered goods before they are installed or sent to the painter. We do not refund extra costs in connection with assembly/disassembly or painting of wrongly delivered or wrongly ordered goods. No cover is provided for wages.

 

4. Right of complaint

In the event of a complaint, contact Nemdele. The reason for the complaint is stated and, by agreement, the product is repaired or sent back.
Special attention must be paid to the fact that any remedial works are never started before they have been accepted by the seller.
No cover is provided for wages unless this is clearly stated on the invoice.
If there is anything other than the statutory right of complaint/exchange, this will appear on the front of the invoice.
It is not possible to determine the colour of a specific body part from a photo on the web shop, therefore the freight for body parts delivered in the "wrong" colour is not credited.
As all the items are unique, not two used spare parts are the same in terms of condition, year, and kilometres. The customer cannot expect to have an item exchanged, but the car recyclers endeavour to resolve all complaints in the best interest of the customer.
Complaints will be dealt with as soon as possible.
The right to complain only applies to errors and defects that were present on the product at the time of delivery and does not include loose parts that are included without charge. For engines, the following can be counted as loose parts: Clutch, turbo, fuel pump, water pumps and nozzles.
Installation instructions are not included as standard.
An engine certificate is included for used engines, which should be read before installation.
All motors are fitted with heat sensors, the indicator melts if the motor has overheated. This can e.g., happen during competitive driving or insufficient maintenance, e.g., when driving without water or oil. If the heat sensor's indicator is melted, the right to claim expires.

 

5. Right of withdrawal

You have 14 days to inform us that you have regretted the purchase and then 14 days to send the item back to us. The right of withdrawal runs from the time the item is delivered to you.
The item must be returned in the same condition and quantity. Always contact Nemdele before the return, as otherwise it will make it difficult to track the part and pay you the money. The inquiry must contain the invoice or reference number and the reason for the return.
Freight is not credited unless the item is defective or misdelivered.
Electronic parts, electronic boxes, etc. can only be returned with a deduction of 50% for any reason, unless otherwise stated on the invoice.

 

6. Packaging

Spare parts can be very sensitive to shock and static electricity, so proper packaging is necessary. If you are in any way in doubt about how an item should be packaged correctly, contact us before sending the item. In extreme cases, a customer can be made liable for damages if an item is sent in an improper manner.

 

7. General conditions

All contracts are concluded in Danish.

 

8. Limitation of liability and reservations

We reserve the right to price increases, force majeure, tax changes, currency changes, out-of-stock items and typing errors.
We assume no responsibility because of the buyer's legal relationship with third parties. To the extent that the company dealt with is responsible to the buyer, their liability is limited to direct losses and thus does not include indirect losses, such as consequential damages, lost earnings, operating losses, painting, assembly, and dismantling costs and more.
We assume no responsibility for products purchased from us working together with products purchased elsewhere. In case of complaint repair, where the fault turns out to be incompatibility between product purchased from Nemdele members and a product purchased from another dealer, the item will be considered 100% O.K. and will be processed according to our complaint’s regulations.

 

9. Confidential Information

We neither pass on nor resell confidential information to third parties, just as we do not subsequently use this information to send advertising emails/SPAM.

 

10. Choice of law and venue

Any dispute is settled according to Danish law at the ordinary courts. Possibly lawsuits regarding the delivered must take place in the seller's jurisdiction.

TRADE TERMS FOR B2B TRADE

 

PAYMENT AND DELIVERY

All prices are without VAT and Ab stock. We reserve the right to change prices without notice.
All shipments are sent with a fixed freight rate, according to freight rates set by the carriers.

 

EXPEDITION ERRORS MUST BE REPORTED WITHIN 8 DAYS

Remember to check the correctness of the delivered item, as no payment is made for possible replacement or painting of a possibly incorrectly delivered item.
Used spare parts must be checked for any defects before assembly.Engines + cylinder heads are fitted with a heat sensor that melts when overheated, which can be important in the event of any complaints.
Engine and gearbox are always shipped without oil. Return motors and gearboxes must be drained of oil. Possibly oil spills will be the sender's responsibility and the latter will be liable for compensation.

 

CYLINDER HEADS

The following MUST be checked before fitting the cylinder head:

- Check for cracks (possibly pressure tested).

- Check if it’s crooked (it may need to be plane sanded).

- Valves are checked (they may need to be grinded).

- Camshaft/rocker arms etc. are checked.

- Nozzles and electrical components are checked.

- The cylinder head is cleaned inside and out before assembly.

 

The above inspection is carried out at the buyer's expense, unless otherwise agreed.
Pressure testing is paid for by the seller if the cylinder head is defective, however a maximum of DKK 500.
If the cylinder head is installed without a pressure test, labor wages will not be covered in the event of a complaint.

 

COMPLAINT

If there is anything other than the right of complaint/exchange without paid wages, this will appear on the front of the invoice.
IN THE CASE OF COMPLAINTS, THE SELLER MUST APPROVE THE COMPLAINT BEFORE WORK BEGINNING, OTHERWISE THE RIGHT TO COMPLAINT IS LOST.
All complaints regarding shipment must be notified to the carrier on receipt of the goods, otherwise there is no right of complaint.
We reserve the right to, as far as possible, select a repairer where the complaint will be rectified, with spare parts supplied by the seller.
Complaints will be dealt with as quickly as possible, but we ask that you will be patient, as complaints usually involve third parties.

 

PRODUCT RETURN

RETURNS OF GOODS ARE ACCEPTED ONLY AFTER PRIOR AGREEMENT WITH NEMDELE.

Returns that are accepted are credited to the debited net purchase price against any deductions.

Prerequisites:

a) Indication of the invoice number and name of the person who has approved that the return can take place.

b) The item is delivered in the same condition as it was received.

c) Frank shipment to our warehouse.

d) The item must be returned within 14 days.

Possibly deduction:

1) A handling fee is calculated.

2) Electronic parts, electronic boxes, etc. can only be returned with a 50% deduction.

3) Parts taken home or specially disassembled will not be returned.

1. General

Through your agreement with Nemdele, personal data about you is collected.
These guidelines have been drawn up based on the EU's Data Protection Regulation, which comes into effect in Denmark from the 25th of May 2018, as well as the new Data Protection Act, which supplements the rules in the Data Protection Regulation and the current Personal Data Act (collectively "applicable legislation").
Below you can read about the information that is collected, including how the information is processed, what it is used for, who has access to the information and who you can contact if you have questions or objections regarding the information collected.

 

2. Personal information

2.1. What is personal data?

Nemdele asks you for your general contact details when you enter into an agreement with us. This is primarily information such as name, address, postcode, telephone, e-mail etc.
Information regarding the name, address, etc. of joint-stock and/or limited liability companies. does not relate to a natural person and is therefore not covered by the Personal Data Regulation.
The personal data we collect is used to identify you as a customer and deliver the services you purchase from us.
The personal data that we collect in connection with fulfilling the agreement will be stored in our IT system or in a physical register.
 

2.2. How long do we store personal data?

Storage of personal data depends on how long your agreement with Nemdele lasts.
When you buy a service from Nemdele, we need your personal data as documentation until the service has been paid for and delivered, a possible the cancellation period has expired.
During the ongoing contractual relationship, this information we collect about you is stored in our IT system, after which personal data is archived.
Your personal data will, as a starting point, be stored by Nemdele for a period of 5 years from the end of the financial year in which the transaction is concluded, according to current regulations. If the agreement with you e.g., has ended in May 2018, according to current regulations we are obliged to store the information until 1 July 2023. When the personal data is no longer relevant and we are not obliged to store it, all personal data relating to you will be deleted.

2.3. What do we use personal data for?

The personal data we collect about you in connection with fulfilling our agreement is primarily used for general customer administration, including, for example, fulfilling the agreement you have entered with the company and for sending invoices.
As a rule, the information will not be passed on to third part. Your general contact information is passed on to our business partners, as we need their help to fulfil the agreement.
In addition, we may process your information if the processing is necessary for the Company (or a third part) to pursue a legitimate interest, unless consideration for you precedes this.
Other disclosure is only permitted if applicable legislation exceptionally permits the disclosure of personal data.

2.4. Protection of personal data

According to current legislation, your personal information must be stored securely and confidentially. We store the personal information you provide in our IT system with limited access and physically locked, your information is only handled by employees who are specially entrusted with this.
Our security measures are checked on an ongoing basis to determine whether the processing of your personal data is handled responsibly and considering your rights as a customer.

2.5. The right to access your personal data

As a customer of Nemdele, you have the right to obtain our confirmation as to whether personal data relating to you is being processed and, if applicable, access to the personal data.
You are also entitled to request and receive personal data about yourself that you have submitted to Nemdele. You are also entitled to object to the processing of your personal data.

2.6. The right to rectification of your personal data

You have the right to have incorrect information about yourself corrected by the company without undue delay.

2.7. The right to delete your personal data

You have the right to have personal data about yourself deleted by Nemdele without undue delay if we do not continue to have a legitimate interest in storing, and including processing, your personal data.
Please note that if Nemdele's processing of your data is still necessary according to applicable legislation, you cannot demand that your personal data be deleted.

2.8. Changes in the processing of personal data

We reserve the right to update and change these guidelines for processing personal data. If the guidelines change, the date of "last updated" at the bottom of the page will be corrected. These guidelines are evaluated and, if necessary, revised once a year and posted on the home page.
